Kinetica Media Client and Loyal-Email Subscriber Privacy Policy

Kinetica Media powers Loyal-Email, a permission-based email marketing service that sends personalized email messages from companies to their customers. Kinetica Media is contractually bound to keep all customer email member data private and prevented from sharing data across multiple Clients or third-party interests.

Kinetica Media does not make members email addresses available to third-party marketers.

Client email members will receive email notifications ONLY from the specific businesses they have subscribed too from Loyal-Email Network.

How does our monthly sweepstakes work?
To be eligible for the $50 sweepstakes prize, client customers must subscribe to the Clients' sweepstakes offering via the "Enter Sweepstakes" button located on the client's message. Every month, Kinetica Media will randomly pick a winner from the "Enter Sweepstakes" database. When a customer email member wins, they will be notified via the email address they provided and will have 48 hours to respond with their name, address, and phone number. Prizes will be either mailed from Kinetica Media to the sweepstakes winner or can be picked up at the company location the winner subscribed at.

Kinetica Media protects all information that is submitted by our visitors, clients, and partners with advanced security technologies. All Kinetica Media applications (ASP), including client's websites, are hosted by eHostingbiz.com which uses state-of-the-art firewall technologies to ensure that our server is impermeable to unauthorized outside network access. Although we believe we exceed industry standard practices in protecting your privacy, due to the existing technological and legal environment, we cannot promise that your information or private communications can remain private one hundred percent of the time in ways not otherwise described in this Policy.

Third parties will not be provided with customer email addresses or personal information unless the participating customer email member independently goes to a client web site(s) and/or brick and mortar store(s) and voluntarily provides information. Kinetica Media does not own participating client customer data obtained on the Kinetica Media network and is not responsible for any information the customer submits to client(s) web site(s) and/or brick and mortar store(s).

Kinetica Media may distribute surveys on Clients' behalf from time to time to collect interest and behavioral information from customer email members. Through survey information, (for example, customer email members typically supply their household income, education, occupation, number of children in the household, home ownership, office at home, and shopping preferences). Although the surveys, sweepstakes, and other special offers all provide a means for our Clients to reward you (customer email members) and the ability for Kinetica Media to further personalize your experience with our service, we do not require that you provide any of this information. However, many of our Clients create offers especially for customer email members with certain characteristics. If you choose not provide this information, you will miss out on these offers and savings opportunities!

Kinetica Media may soon allow interested customer email members the opportunity to opt-in to other participating businesses in the Kinetica Media network. If at any time an existing customer email member opts-in to another Kinetica Media business on the network, (via "tell a friend" or manually via the "kinetica-media.com website"), the customer email member will only receive messages from the business(s) they elected to receive messages from.

Kinetica Media is not responsible for any client/customer contact outside the Kinetica Media Network.

Like many websites on the internet, Kinetica Media and Client websites may link to pages located on websites maintained by various other organizations not bound by this Privacy Policy. Once you select a link that takes you to another website, you are subject to the privacy policy of the website containing that page. The privacy policy of other organizations may differ in the level of security, use of cookies and use of personally identifying information. Please note, however, that these other sites may have privacy policies that differ from those of Kinetica Media and Kinetica Media Clients. Several of these other sites may share or otherwise use the personal information you provide them. We have no control over any personal information you choose to provide those websites.

Kinetica Media is not legally responsible for any unauthorized access to participating Client accounts or any damage due to power surges, bugs, viruses, worms, hardware, software, or sever damage. Kinetica Media is not legally responsible for any loss or gain incurred from client/customer/3^rd party transmissions of any sort over the Kinetica Media network.

At any time and without notice, we may request and collect, non-personally identifiable information (such as (i) IP address; (ii) domain server; (iii) type of computer operating system (Mac or Windows); (iv) type of web browser (Netscape, Microsoft Explorer, etc.); and (v) the Internet service provider ("ISP") used to access the Site/Service) from you in order to perform troubleshooting (i.e. to help diagnose problems with our server) or administer our Site and Service(s).

Kinetica Media reserves the right to deactivate any customer email member or Client at its sole discretion if we believe that member/Client has used the Kinetica Media website and/or service(s) or e-mail in a way that is fraudulent or damaging to Kinetica Media, it's Client advertisers, or Trusted Third Party Processors.

Kinetica Media’s Permission Policy

The transmission of unsolicited commercial email (ECM) or "Spam" is expressly forbidden throughout the Kinetica Media network. Kinetica Media does not and will never promote any such activates (Spam) over the Kinetica Media network or any future Kinetica Media network or channel. Kinetica Media respects privacy, individuality and the First Amendment of the Constitution, but does not condone the transmission of unsolicited commercial emails to patrons who have not given permission to receive them.

How does Kinetica Media avoid ECM or "Spam"?

The Kinetica Media service requires companies to use Kinetica Media (Loyal-Email) for communicating to only individuals whom they already have a relationship. If additional sources of information are used, companies may only send emails to individuals who have personally shared their address for the purpose of receiving offers and information in the future (Often called opt-in lists). We encourage companies to personalize their communication with information that indicates they have an existing relationship with their customer(s).

If companies use an external source for communication data, we require those companies to supply the source of their customer data to us in the event recipients complain about receiving unsolicited email (ECM) from Kinetica Media. We encourage companies to respect their customers' permission and attention by controlling the frequency of mailings to individual email addresses.

How does Kinetica Media protect your privacy?

How do participating customer email members "unsubscribe" of Kinetica Media client email messages?

Each Loyal-Email email message sent through the Loyal-Email mailing system contains an easy, automated way for customer email members to cease receiving email from the specific participating Client. A button entitled "Unsubscribe" will be present on every client email message sent. Customer email members can easily unsubscribe or "opt-out" from receiving future Client email messages by clicking the "Unsubscribe" button and following the unsubscribe prompt. Once an email address has been unsubscribed, the customer email member will no longer receive any uninvited messages from the particular Client they unsubscribed from using the Loyal-Email service.

You agree by using Loyal-Email or Kinetica Media service(s), not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purpose other than as provided herein, any portion of the Kinetica Media service(s), use of the service(s), or access to the service(s).
